Juris-Data is one of the largest case-study base in France. The case studies are indexed by legal classification elaborated by the Juris-Data Group. Knowledge engineering was used to design an intelligent interface for information retrieval based on this classification. The aim of the system is to help users find the case-study which is the most relevant to their own.The approach is potentially very useful, but for standardising it for other legal document bases it is necessary to extract a legal classification (...) of the primary documents. Thus, a methodology for the construction of these classifications was designed together with a framework for index construction. The project led to the implementation of a Legal Case Studies Engineering Framework based on the accumulated experimentation and the methodologies designed. It consists of a set of computerised tools which support the life-cycle of the legal document from their processing by legal experts to their consultation by clients. (shrink)

Although international research is increasing in volume and importance, there remains a dearth of knowledge on similarities and differences in “national human research ethics”, that is, national ethical guidelines, Institutional Review Boards, and research stakeholder’ ethical attitudes and behaviors. We begin to address this situation by reporting upon our experiences in conducting a multinational study into the mental health of children who had a parent/carer in prison. The study was conducted in 4 countries: Germany, Great Britain, Romania, and Sweden. Data (...) on NHREs were gathered via a questionnaire survey, two ethics-related seminars, and ongoing contact between members of the research consortium. There was correspondence but even more so divergence between countries in the availability of NEGs and IRBs and in researcher’ EABs. Differences in NHREs have implications particularly in terms of harmonization but also for ethical philosophy and practice and for research integrity. (shrink)

Dans ce court article, je veux montrer que l'injustice sociale est caractérisée par l'insatisfaction, qui produit une classe de hors-caste, car elle n'a ni biens, ni droits. De plus, il y a faille et problème, car Hegel conçoit la société civile à partir d'une axiologie de l'harmonisation et de l'intégration que démentent (...) les processus économiques. En revanche, la perspicacité du diagnostic hégélien démontre bien que l'absence d'intégration et de reconnaissance sociale est un mal aussi grand que la privation matérielle.Although Hegel offers no solution to the problem of social injustice, it is important to analyse this problem, for it defines the limits of civil society. In this short paper, I shall try to show that social injustice is characterized by the dissatisfaction that produces a class of outcaste people who have no goods, nor rights. Furthermore, there is a shortcoming and a problem in Hegel's conception of civil society: it is based on an axiology of harmonization and integration, which is contradicted by economic processes. However, the perspicacious hegelian diagnosis shows clearly that the absence of integration and social recognition is as great an evil as material deprivation. (shrink)

Au détour de l'ordre géométrique, dans un scolie de la Quatrième partie de l'Éthique faisant suite à l'énoncé de la règle fondamentale qui associe l'utilité du corps humain, et par conséquent le bien de l'individu, à la recherche d'une constance fondamentale dans le rapport de ses parties, surgit un scolie baroque, où passe l'ombre de la mort et qui débouche sur d'inquiétantes possibilités de mutation, voire de transmutation de l'identité : « Il arrive qu'un homme subit de tels changements, que (...) je ne dirai pas aisément qu'il est le même. C'est ce que j'ai entendu raconter de certain poète espagnol qui avait été atteint de maladie et qui, bien qu'il en fût guéri, demeura cependant dans un tel oubli de sa vie passée, qu'il ne croyait pas que les nouvelles et les tragédies qu'il avait faites fussent de lui ; et certes on eût pu le tenir pour un nourrisson adulte, s'il eût oublié aussi sa langue maternelle... » De ce texte perturbateur et de sa « contradiction » centrale, qui ont semé le trouble chez les commentateurs, François Zourabichvili qui en propose une explication systématique fait le fil conducteur d'une relecture complète des relations qui associent la métaphysique spinozienne à son anthropologie et à sa politique, centrée sur la question de la transformation comme « oubli », voire amnésie d'une forme antérieure, et « imagination », chimérique ou non, d'une nouvelle aptitude du corps. Il démontre ainsi la rigoureuse correspondance qui, d'un bout à l'autre de l'œuvre, associe la question d'une sortie de l'enfance à celle d'une émancipation de l'imaginaire monarchique. A l'encontre d'une lecture naïvement « révolutionnaire » du spinozisme, surgit alors ce qu'on peut appeler un conservatisme : mais dont le paradoxe est éclatant, car il tend moins à préserver l'état de choses existant qu'à inventer les conditions d'une vraie conservation de soi (neutralisation de la mort et de la servitude). René Char Spanish-born writer Jorge Semprun, in his memoir of deportation to Buchenwald, L'écriture ou la vie (1994), tells how in (...) spring 1945 he first came to read what is arguably René Char's first influential book of poetry, Seuls demeurent, and to recite on the liberated camp's assembly ground one of the keynote poems of the collection, "La liberté," as an emblem of his survival. Although Char had published several collections prior to World War II, Seuls demeurent was a major sign that something had changed in his poetry and politics, that he was about to entrer dans la carrière, to borrow the phrase that historian Olivier Wieviorka uses to describe the political and cultural ascension of French resisters in the postwar era. 1 A Gaullist officer, Marc, present at the liberation of Buchenwald in mid-April 1945, gave a copy of Seuls demeurent to Semprun, who had been deported for resistance activities in France. Semprun immediately felt that this book transcended what better-known writers had published from the late 1930s through early 1944, when he lost contact with a French literary scene he knew well (L'écriture, 79-87).Indeed, Seuls demeurent resonated so strongly in the post-Liberation years that it furnished a major reference point in Foucault's preface to his Folie et déraison (1961), where the philosopher links his own critique of social repression with Char's "Partage formel," the poetic sequence of aphorisms that concludes Seuls demeurent. Without mentioning his source (either poet or title of the poem), Foucault quotes from aphorism XXII, where Char praises the uncanny murmur he calls "étrangeté légitime," 2 and where we might hear the whispers of the Resister's legitimate revolt against repression as well as a legitimate strangeness or new self-assertive idiom within poetry. [End Page 109]It is interesting that Semprun and Foucault route their early encounters with Char's writing through the more explicitly poetical Seuls demeurent, and not through Feuillets d'Hypnos, a series of maxims, action portraits, and homages published in 1946 inGallimard's « Espoir » series, directed by Albert Camus, Char's friend. In Feuillets d'Hypnos, Char described, aphoristically more than anecdotally, his experience in the southern French Resistance. Seuls demeurent (and eventually other poems in a similar vein from his 1948 compendium Fureur et mystère, into which Seuls demeurent was merged alongside Feuillets d'Hypnos) purveyed Char's most lasting political and ideological impact on the generations represented by Semprun and Foucault.To understand how Seuls demeurent and the liberational poetics it initiated might spur two such nonconformist yet widely divergent left intellectual projects—Semprun's politique fiction, which resulted in novels like La deuxième mort de Ramón Mercader (1969), and Foucault's archeologies of social control—we must try to read Char's work back into the immediacy of its era, with the help of historians like H.R. Kedward, Henri Michel and others, despite the fact that Seuls demeurent is striated with discernible secondary work—the displacements and condensations that the Occupation and Liberation induced in its survivors and itinerants. Semprun and Foucault, in their quotations from Char's poetry, attest to the sense of personal empowerment that his voice effected. Perhaps something in his poetics, especially its mode of interaction with history, anticipated such readers.I will explore these ideas by showing, first, how in Seuls demeurent Char's poetic re-enactment of his passage through WWII foregrounds historical events and violence, but privileges poetry as a means of giving overriding sense to the war, and more specifically to the French internal Resistance, to the extent that it was morally distinct (if not always organizationally severed) from De Gaulle's external... She was a pioneer in her emphasis on visual culture, Fellow of the British Academy, and a remarkable twentieth century philosopher. This paper considers the early reception of Einstein's theory of relativity in the Arab world, with emphasis directed to its popularization. Educated Arabs generally had no contention with Einstein's political, religious or cultural background. On the contrary, they viewed him as the genius of the age and defended him against his critics.

A new theoretical approach to language has emerged in the past 10–15 years that allows linguistic observations about form–meaning pairings, known as ‘construc- tions’, to be stated directly. Constructionist approaches aim to account for the full range of facts about language, without assuming that a particular subset of the data is part of a privileged ‘core’. Researchers in this field argue that unusual constructions shed light on more general issues, and can illuminate what is required for a complete account of (...) language. (shrink)

We contend that diagrams are tools not only for communication but also for supporting the reasoning of biologists. In the mechanistic research that is characteristic of biology, diagrams delineate the phenomenon to be explained, display explanatory relations, and show the organized parts and operations of the mechanism proposed as responsible for the phenomenon. Both phenomenon diagrams and explanatory relations diagrams, employing graphs or other formats, facilitate applying visual processing to the detection of relevant patterns. Mechanism diagrams guide reasoning about how (...) the parts and operations work together to produce the phenomenon and what experiments need to be done to improve on the existing account. We examine how these functions are served by diagrams in circadian rhythm research. (shrink)

In this paper I discuss the four Women and Labour conferences which were held in Australian capital cities over the seven years between 1978 and 1984. I explore the ways in which the history of Australian feminist activism during this period could be written, questioning in particular the claim that the Women and Labour conferences have been central to the history of Australian feminism. I discuss the ways in which a historical sense could be established, using writings about the conferences (...) as historical ‘evidence’, that race and ethnic divisions between women had not been important to the ‘women's movement’ until 1984. In other words, I challenge the construction of this conference as a turning point – not only in the feminist politicization of immigrant and Aboriginal women, but also in the politicization of all feminists about race and ethnic divisions. More broadly, I am interested in how a history would be written if it aimed to get to the ‘truth’ about racism and about the feminist activism of immigrant women. How would the apparent lack of written ‘evidence’ – at least until 1984 – of immigrant women's feminist activism, and of the awareness of Australian feminists about issues of racism, be written into this history? In addition, I suggest that it is important to the writing of feminist history in Australia that published documentation has been mostly produced by anglo women, and is thus partial and mediated by the lived, embodied experiences of anglo women. Finally, my intention is to interrogate commonly understood narratives about Australian feminist history, to challenge their seamlessness, and to suggest the importance of recognizing the tension within feminist discourses between difference as benign diversity and difference as disruption. In response to a global population with increasingly complex issues at the end of life, a movement in the U.S. has emerged incorporating doulas into end-of-life care. These end-of-life (EOL) doulas are not just focused on the quality of life, but also the quality of death. Like birth doulas, who provide support for pregnant patients and their families, EOL doulas help alleviate physical and mental discomfort in those who are dying. In this paper, we explore the role of EOL doulas (...) in improving the care of unrepresented patients, who lack decision-making capacity and have no surrogates or documents to guide their healthcare decisions. We argue that EOL doulas may help this traditionally underserved population experience a “good death” by answering several ethical and procedural challenges. As quasi-independent, non-medical members of the healthcare team, they provide a balancing, advocating voice on behalf of the patient, and may also help reduce inappropriate treatment, delays in care, and the overburdening of the public guardianship system. As such, attention should be given to formally defining their place within the healthcare infrastructure. Ultimately, we contend that EOL doulas are key to ensuring optimal, ethical care for unrepresented patient populations. (shrink)

Cognitive science is, more than anything else, a pursuit of cognitive mechanisms. To make headway towards a mechanistic account of any particular cognitive phenomenon, a researcher must choose among the many architectures available to guide and constrain the account. It is thus fitting that this volume on contemporary debates in cognitive science includes two issues of architecture, each articulated in the 1980s but still unresolved: " • Just how modular is the mind? – a debate initially pitting encapsulated mechanisms against (...) highly interactive ones. • Does the mind process language-like representations according to formal rules? – a debate initially pitting symbolic architectures against less language-like architectures. " Our project here is to consider the second issue within the broader context of where cognitive science has been and where it is headed. The notion that cognition in general—not just language processing—involves rules operating on language-like representations actually predates cognitive science. In traditional philosophy of mind, mental life is construed as involving propositional attitudes—that is, such attitudes towards propositions as believing, fearing, and desiring that they be true—and logical inferences from them. On this view, if a person desires that a proposition be true and believes that if she performs a certain action it will become true, she will make the inference and perform the action. (shrink)

This paper focuses attention on the stakeholder attribute of legitimacy. Drawing upon institutional and stakeholder theories, I develop a framework of stakeholder legitimacy based on its three aspects—legitimacy of the stakeholder as an entity, legitimacy of the stakeholder’s claim, and legitimacy of the stakeholder’s behavior. I assume that stakeholder legitimacy is socially constructed by management and that each of its three aspects exists in degree in the manager’s perception. I discuss how these aspects interact and change over time, and propose (...) an agenda for future research on stakeholder legitimacy. (shrink)

We contrast reactive and endogenously active perspectives on brain activity. Both have been pursued continuously in neurophysiology laboratories since the early 20thcentury, but the endogenous perspective has received relatively little attention until recently. One of the many successes of the reactive perspective was the identification, in the second half of the 20th century, of the distinctive contributions of different brain regions involved in visual processing. The recent prominence of the endogenous perspective is due to new findings of ongoing oscillatory activity (...) in the brain at a wide range of time scales, exploiting such techniques as single-cell recording, EEG, and fMRI. We recount some of the evidence pointing to ways in which this endogenous activity is relevant to cognition and behavior. Our major objective is to consider certain implications of the contrast between the reactive and endogenous perspectives. In particular, we relate these perspectives to two different characterizations of explanation in the new mechanistic philosophy of science. In a basic mechanistic explanation, the operations of a mechanism are characterized qualitatively and as functioning sequentially until a terminating condition is realized. In contrast, a dynamic mechanistic explanation allows for non-sequential organization and emphasizes quantitative modeling of the mechanisms's behavior. For example, with appropriate parameter values a set of differential equations can be used to demonstrate ongoing oscillations in a system organized with feedback loops. We conclude that the basic conception of mechanistic explanation is adequate for reactive accounts of brain activity, but dynamical accounts are required to explain sustained, endogenous activity.
